By accessing our Site, requesting a consultation, or engaging our services, you agree to be bound by these Terms. If you do not agree, please do not use our Site or services.

1. Services Offered

Stillwater Forestry LLC is an owner-operated Montana limited liability company specializing in:

  • Fire Mitigation & Fuels Reduction / Thinning

  • Storm Cleanup

  • Grant Conservation Work

  • Forestry Mulching

  • Home Site Preparation

  • Free Property Consultations

2. Consultations & Quotes

  • Free Consultations: We offer complimentary property consultations to assess your project needs. A consultation does not obligate us to perform work, nor does it obligate you to hire us.

  • Quotes and Estimates: Any price estimate provided during or after a consultation is valid for thirty (30) days from the date issued, unless otherwise stated in writing. Estimates are subject to change if the scope of work changes or if unforeseen site conditions are discovered.

3. Client Responsibilities & Property Access

To perform our services safely and effectively, you (the "Client") agree to:

  • Property Ownership/Authorization: Warrant that you either own the property or have explicit, legal authority from the owner to authorize the requested work.

  • Access: Provide safe and unobstructed access to the property for our team, vehicles, and heavy machinery on the scheduled work days.

  • Boundaries & Utilities: Clearly identify and mark property lines, underground utilities, irrigation systems, hidden hazards, or pipes. We are not responsible for damage to unmarked underground utilities or structures.

  • Permits: Unless explicitly agreed otherwise in a written contract, the Client is responsible for obtaining any necessary HOA approvals, local permits, or variances.

4. Environmental and Weather Conditions

Given the nature of forestry, fire mitigation, and site preparation work in Montana:

  • We reserve the right to delay or reschedule work due to adverse weather conditions, high fire danger restrictions (e.g., hoot-owl restrictions), saturated soil (to prevent excessive ground damage), or other acts of nature.

  • While we utilize professional equipment (such as forestry mulchers) designed to minimize impact, heavy machinery may cause temporary cosmetic ground disturbance. We are not liable for standard turf, soil, or driveway wear-and-tear resulting from necessary equipment access.

5. Payment Terms

  • Payment terms, deposits, and milestone schedules will be detailed in your specific project contract.

  • Invoices are due upon receipt or within the timeframe specified on the invoice. Late payments may be subject to a finance charge of 1.5% per month or the maximum rate permitted by Montana law.

6. Limitation of Liability

To the maximum extent permitted by Montana law, Stillwater Forestry LLC, its owner, and employees shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with our website or services. Our total liability for any claim arising out of our work shall not exceed the total amount paid by you to us for the specific service giving rise to the claim.

7. Intellectual Property

All content on this Site—including text, graphics, logos, images, and project portfolios—is the property of Stillwater Forestry LLC and is protected by copyright and trademark laws. You may not use our content without express written permission.

8. Governing Law

These Terms and their interpretation are governed by the laws of the State of Montana, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in Montana.
